By accessing or using RentClub.ca and members.rentclub.ca (“we,” “us,” or “our”), a platform offering home location search and home listing services for individuals or companies seeking rental properties to rent or list, you agree to be bound by these Terms of Service (“Terms”). If you do not agree with any part of the Terms, you may not access or use our platform.
Services Provided
RentClub.ca and members.rentclub.ca offers tools and services to assist users in identifying, locating, and evaluating rental properties as well as listing properties for rent. These services may include property search tools, personalized recommendations, communication with property listers or agents, and informational resources.
EligibilityEligibility
You must be at least 19 years old and capable of forming a binding contract to use our services. By using the platform, you represent and warrant that you meet these requirements.
User Responsibilities
You agree to use the platform lawfully and responsibly. You shall not:
Share your account credentials with others or allow unauthorized access to your account.
Use the platform for any unlawful purpose;
Provide false or misleading information;
Interfere with the operation of the platform or access it using automated means without our permission;
No Real Estate Brokerage Relationship
RentClub.ca and members.rentclub.ca is not a licensed real estate broker, agent, or property manager. We do not facilitate transactions or collect rents and do not provide any management services. Any interactions or agreements made between users and third-party property listers or agents are solely between those parties.
Third-party Content and Links
Our platform may display or link to third-party content, websites, or services. We are not responsible for the accuracy, legality, or content of any third-party materials.
Limitation of Liability
To the fullest extent permitted by law, RentClub.ca and members.rentclub.ca shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data or other intangible losses resulting from:
- Your use or inability to use the services;
- Any unauthorized access to or use of our servers and/or any personal information stored therein;
- Any conduct or content of any third party on the platform.
Indemnification
You agree to indemnify, defend, and hold harmless RentClub.ca, member.rentclub.ca its affiliates, officers, directors, employees, agents, licensors, and partners from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with:
- Your access to or use of the platform;
- Your violation of these Terms;
- Your violation of any third-party right, including intellectual property rights or privacy rights.
Disclaimer of Warranties
The platform and services are provided on an “as is” and “as available” basis. RentClub.ca makes no warranties or representations, express or implied, regarding the platform, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of British Columbia, without regard to its conflict of law principles.
